1. ACCEPTANCE OF TERMS
Egypt Memory© and
its affiliates provide their services to you subject to the following
TERMS. If you visit or shop at Egypt Memory©, you accept these TERMS.
Egypt Memory© reserves the right to update the TERMS at any time without notice to you. Please read them carefully.
2. OWNERSHIP OF THE WEBSITE
Egypt Memory© is the
trading name of an E-Commerce website. Egypt Memory© is owned
by The Center for Documentation of Cultural and Natural Heritage CULTNAT
and powered by IBM.
3. DESCRIPTION OF SERVICE
The Egypt Memory© website includes an unprecedented collection
of high-resolution creative Royalty Free (RF) images that covers all
the Egyptian culture from the dawn of the pharaohs till the modern
era. Moreover, the website includes different assortments of products
(Books, CDs, Atlases, Maps ...), that present different aspects of
the Egyptian heritage, all of which are available in the most accessible
and usable way and at very competitive prices.
All images on the Egypt Memory© website are available in two
delivery methods; Shipping and Download, while other products -so
far- are available through Shipping only. It is worth mentioning
that the download process is final and non-refundable.

All the services offered by Egypt Memory©, including any
updates, enhancements, and/or the addition of any new features,
are subject to the TERMS.
4. Registration / Accounts
If any of the Services requires you to open an account, you must
complete the registration process by providing us with current, complete
and accurate information as prompted by the applicable registration
form.
You also will choose a password and a user name. You are entirely
responsible for maintaining the confidentiality of your password and
account. Furthermore, you are entirely responsible for any and all
activities that occur under your account.
Egypt Memory© will not be liable for any loss that you may incur
as a result of someone else using your password or account, either
with or without your knowledge. However, you could be held liable
for losses incurred by Egypt Memory© or another party due to
someone else using your account or password. You may not use anyone
else's account at any time, without the permission of the account
holder.
Egypt Memory© and its affiliates reserve the right to refuse
service, terminate accounts, remove or edit Content, or cancel orders
in their sole discretion.
5. UNAUTHORIZED USES
Without limitation, Egypt Memory© Content may not be used as
a trademark, unlawful purpose or use or to defame any person, or to
violate any person's right of privacy, publicity or moral rights,
or to infringe upon any copyright, trade name or trademark of any
person or entity.
You do not acquire and shall not claim any right (trademark, copyright
or otherwise) in the Content itself apart from the end use.
6. LIMITED WARRANTY AND DISCLAIMER
Egypt Memory© warrants that the Content, as provided hereunder,
and when used as authorized in these TERMS, will not infringe any
copyright, trademark, moral right, right of privacy or right of publicity,
or any other intellectual property right of any third party.
The products provided by Egypt Memory© to you, will be free from
defects. If for any reason, the customer is dissatisfied with his/her
purchase, all they have to do is return their purchase in its original
packaging, with the original packing slip and Egypt Memory© Order
Confirmation E-mail Receipt within 30 days of the purchase, for a
refund or exchange.

for a three-week period, starting from the order creation date.

Egypt Memory© makes no warranties, nor shall Egypt Memory©
be liable, for any claims related to or arising from Your use of Content
which (a) has been modified by You, (b) has been combined by You with
other Content, products, text, or materials.
7. LIMITATION OF LIABILITY
You understand and agree that Egypt Memory© is not liable for
any indirect, consequential ,or punitive damages, including, but not
limited to, any loss of profits , loss of data, howsoever caused,
and on any theory of liability, whether for breach of contract, tort
(including negligence and strict liability), or otherwise resulting
from:
(1) The use of, or the inability to use, Egypt Memory© services.
(2) Unauthorized access to or alteration of your transmissions or
data.
(3) Reliance on Content on our site.
(4) Any other matter relating to our site or Egypt Memory© services.
These limitations will apply whether or not Egypt Memory© has
been advised of the possibility of such damages.
8. LINKS
Please be aware that the Egypt Memory© website may contain
links to other sites that are beyond control and are covered by their
own Privacy Policies. Egypt Memory© does not assume any responsibility
for the Privacy Policies or practices of other sites.
9. ORDER ACCEPTANCE
Please note that there may be certain orders that we are unable
to accept and must cancel. We reserve the right, at our sole discretion,
to refuse or cancel any order for any reason.
For your convenience, you will not be charged until your payment method
is authorized, the order information is verified for accuracy and
your order is shipped. Some situations that may result in your order
being canceled include:
1- Limitations on quantities available for purchase.
2- Inaccuracies or errors in product or pricing information.
3- Problems identified by our credit and fraud avoidance department.
We may also require additional verifications or information before
accepting any order. We will contact you if all or any portion of
your order is canceled or if additional information is required to
accept your order. If your order is canceled after your credit card
has been charged, we will issue a credit to your credit card in the
amount of the charge.

10. PRICING The List Price displayed for products on our website represents
the full retail price listed on the product itself. The List Price
is a comparative price estimate and may or may not represent the prevailing
price in every area on any particular day.
With respect to items sold by Egypt Memory©, we cannot confirm
the price of an item until you order; however, we do NOT charge your
credit card until after your order has entered the shipping process.
Despite our best efforts, a small number of the items in our catalog
may be mispriced.
If an item's correct price is higher/lower than
our stated price, we will, at our discretion, either contact you for
instructions before shipping OR cancel your order and notify you of
such cancellation.
11. COPYRIGHT AND TRADEMARK All high-resolution images that the customer downloads from the
Egypt Memory© website have invisible watermarks. The only kind
of images that has visible watermarks is the "Zoom" kind.
All high-resolution images the customer downloads are accompanied
by the Royalty-Free License. The Royalty Free is a concept where user
of the images does not have to pay any royalty for repeated use of
the images. The buyer does not own the copyright of the images but
has bought out the right to use the images legally without further
payments or interruptions from the seller. These images cannot be
resold or transferred but they do offer a wide range of benefits;
mainly lower pricing and convenience.
It is worth mentioning that the Egypt Memory© website owns the
intellectual property for ALL kinds of Content present on the website.
12. LAW AND JURISDICTION These TERMS OF USE and your use of the Site are governed by the
laws of The Arab Republic of Egypt, without regard to its choice of
law provisions. The courts located within The Arab Republic of Egypt,
will have exclusive jurisdiction over any and all disputes arising
out of, relating to or concerning these TERMS OF USE and/or the Site
or in which these TERMS OF USE and/or the Site are a material fact.
13. CANCELLATION/TERMINATION Egypt Memory© may, without
further obligation or any liability to You or any other person or
entity, terminate these TERMS and your license to use the Content in
the event You fail to comply with any of these TERMS. Upon any
termination, cancellation or expiration of these TERMS, neither You
nor any other person or entity covered by the license granted to you
under these TERMS shall have any further right to make any use of
the Content. The Termination of the TERMS on the part of Egypt
Memory© means banning the user from accessing the Egypt Memory©
website and prohibiting him from using the Egypt Memory© Services.
